Welcome to the J. Peterman website, www.jpeterman.com (the "Site"), owned and operated by Habersham Brands, Inc. and its affiliates ("Habersham Brands," "we," "us"). These terms (the "Terms") govern your use of the Site. Using the Site means you agree to them. If you do not agree, please do not use the Site. We may change the Site and these Terms from time to time and will post changes here, so please review them when you visit.

Use of this Site

We give you access to the Site subject to these Terms. The Site and everything on it, including text, data, artwork, images, photographs, graphics, icons, sound, software and code ("Materials and Content"), belongs to Habersham Brands or its suppliers or licensors and is protected by patent, trademark and copyright laws. Except as these Terms allow, you may not copy, reproduce, publish, modify, distribute or otherwise use any Materials and Content for any public or commercial purpose without our prior written permission.

We grant you a personal, limited, non-exclusive, non-transferable license to access the Site and use its information and services. We may, at our sole discretion and without notice, revise the products and services described on the Site, or change, suspend or discontinue any part of the Site, and we will not be liable to you or anyone else for doing so. We may also set rules and limits on use of the Site, or restrict your access to part or all of it, at any time.

Products, pricing and resale

Information on the Site is not a binding offer to sell any product or to make it available in your area. We may accept or decline any order, in whole or in part, even after you receive an order confirmation or your card has been charged. You may not buy items from the Site for resale.

Prices are in U.S. dollars and valid only in the United States. If a product is listed at an incorrect price, we may refuse or cancel orders for it, even after the order is confirmed or your card is charged. If we cancel an order after charging your card, we will credit your card.

We try to keep the Site accurate and current, but it may contain technical or typographical errors. We may correct them at any time without notice. Products shown on the Site may not be available in every region.

All offers may be changed or canceled at any time and are subject to availability. Offers cannot be combined with other offers or applied to previous orders. Discounts and coupons have no cash or credit value and are not valid on gift cards.

Final sale

All Trunk Sale items are final sale, with no returns or exchanges. Final-sale status is shown on each product page and applies to every Trunk Sale purchase.

Prohibited uses

You may use the Site only for lawful, personal, noncommercial purposes: viewing the Site, buying products, giving us information and downloading product information for your own review. You are responsible for anything you post or send to the Site. You agree not to use the Site to:

  • Post information that is incomplete, false, inaccurate or not your own.
  • Do anything that would be a criminal offense, create civil liability, or violate any law or regulation.
  • Post material that is copyrighted or owned by someone else, unless you own it or have permission.
  • Post material that reveals trade secrets, unless you own them or have permission.
  • Post material that infringes anyone's intellectual property, privacy or publicity rights.
  • Send information or software from the Site to other countries in violation of U.S. export control laws.
  • Interfere with the Site's or our networks or security, or use the Site to gain unauthorized access to any other system.
  • Post material that violates any applicable law or regulation.

Security rules

Violating system or network security may lead to civil or criminal liability. We will investigate violations and may work with law enforcement to prosecute those involved. You may not violate or attempt to violate the Site's security, including by:

  • Accessing data not meant for you, or logging into a server or account you are not authorized to use.
  • Probing, scanning or testing the vulnerability of any system or network, or breaching security or authentication measures, without permission.
  • Interfering with the Site, our service to other visitors, our hosting provider or our network, including by uploading a virus, overloading, flooding, mail bombing or crashing the Site.
  • Forging any TCP/IP packet header or any part of the header information in any email or posting.

Proprietary rights

As between you and us, Habersham Brands (or the company whose marks appear on the Site) owns or is the authorized user of the trademarks, trade names and service marks on the Site, and owns or licenses the Materials and Content. The J. Peterman logos, designs, titles, phrases, product names and related trademarks, copyrights and trade dress ("J. Peterman Intellectual Property") are owned by or licensed to Habersham Brands. You may not use any J. Peterman Intellectual Property without our prior written consent, and nothing on the Site grants you a license to it.

Use of the Site does not give you a license to any Materials and Content. You may not modify, rent, lease, loan, sell, distribute or create derivative works from them, and any commercial use of the Site is prohibited unless we approve it. Unauthorized use may violate copyright and other laws and make you liable. The Site's design, text, graphics, interfaces, and their selection and arrangement are protected by law, including copyright law.

Your information and feedback

You are responsible for the accuracy of any information you give us. Feedback, questions, comments, suggestions and ideas you send us are not confidential. They become our property, and you assign us all worldwide rights in them. We may use, reproduce, disclose and distribute them for any purpose, including developing and marketing products, without obligation to you.

Our use of your personal information, such as your name, is governed by our Privacy Policy above.

Limitation of liability

You use the Site at your own risk. The Site is provided "AS IS." HABERSHAM BRANDS DISCLAIMS ALL WARRANTIES, CONDITIONS, REPRESENTATIONS AND ENDORSEMENTS OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE SITE AND ALL CONTENT, MATERIALS, FUNCTIONS AND SERVICES ON IT, INCLUDING WARRANTIES OF AVAILABILITY, ACCURACY, COMPLETENESS, USEFULNESS, UNINTERRUPTED ACCESS, TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE TIMELY, SECURE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE WILL MEET YOUR EXPECTATIONS. NO ADVICE OR INFORMATION YOU OBTAIN THROUGH THE SITE CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE REMEDY IS TO STOP USING IT. Indemnity

You agree to defend, indemnify and hold harmless Habersham Brands and its directors, officers, employees, agents and affiliates from all claims, liabilities, damages, costs and expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these Terms, or anything you post or send through the Site, including any claim that your material infringes a third party's rights.

Mobile terms of service

The J. Peterman mobile message service (the "Service") is operated by Habersham Brands, Inc. Using the Service means you agree to these mobile terms. We may change or cancel the Service or any of its features without notice and, where the law allows, change these mobile terms at any time. Continuing to use the Service after a change means you accept it.

By signing up for our texts, you agree to receive recurring SMS/text messages from and on behalf of J. Peterman at the mobile number you provided, even if that number is on a state or federal Do Not Call list. Messages may be sent with an automatic telephone dialing system or other technology. Service messages may include order updates and account alerts. Promotional messages may include offers, specials and cart reminders.

You do not have to sign up to make a purchase, and your consent is not a condition of any purchase. Participation is voluntary.

We do not charge for the Service, but message and data rates from your wireless provider may apply. Message frequency varies. Check your mobile plan for details. You are responsible for all charges from your wireless provider.

You may opt out at any time by replying STOP to any of our text messages, or by using the unsubscribe link where available. You will receive one confirmation text, and no further messages will be sent unless you start them. If you subscribe to more than one of our text programs, you must opt out of each separately unless the law requires otherwise.

We may change the short code or phone number used for the Service and will notify you of changes. Messages you send to a number we no longer use, including STOP or HELP, may not be received, and we are not responsible for honoring them.

Wireless carriers are not liable for delayed or undelivered messages. You agree to give us a valid mobile number. If you change numbers, you will need to sign up again. Where the law allows, we are not liable for failed, delayed or misdirected messages, errors in them, or actions you take based on them.

General information

These Terms are the entire agreement between you and Habersham Brands regarding the Site and replace any prior agreements. Additional terms may apply to certain parts of the Site. We may end this agreement and deny you access to the Site at any time, without notice, if we decide you have not followed these Terms.

No joint venture, partnership, employment or agency relationship exists between you and Habersham Brands because of these Terms or your use of the Site.

Any claim you have related to Habersham Brands or the Site must be brought within one (1) year after it arises.

If we do not enforce any part of these Terms, that is not a waiver. If any part is found invalid, the rest remains enforceable.

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute under these Terms will be resolved only in an appropriate federal or state court located in Kentucky.

We operate the Site from the United States, and all information is processed in the United States. We do not claim the Site is appropriate or available for use elsewhere. You agree to follow all laws that apply to your use of the Site.

Software downloaded from the Site is subject to U.S. export controls. By using the Site, you confirm that you are not a national or resident of any country subject to a U.S. trade embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

You may not assign these Terms or your rights or obligations under them without our written consent. These Terms benefit our successors, assigns and licensees. Section titles are for convenience only and have no legal effect.
